Ok I would like to update that I have just received my order of a blackberry phone. It has been sent from Guangdong, China.
The website indicates that its is based in Sydney....they lie.
The charger that comes with the phone does not suit the blackberry. However, I do not want to return it as I don't feel like dealing with this website ever again.

I also have become a victim of this fraud. I ordered a Nokia E63 and paid for it. I have not received anything. I requested a refund and have not received it. I am going to the Department of Fair Trading and also may go to the Police depending on the advice received from the DFT. If you want to know how I go my email is

They lied. I don't think they're rebuilding. As you can see, the redirect link is "cpanel1.trafficwise.com.au/suspended.page/".
They are even tried to milk some more money before the page went down by telling people to use direct deposit when Paypal suspended their account.
Good luck with the pursuit to this criminal act.

Ok guys, do the following if you want to have a chance to get your money back:

Go to the police department close to you and report the scam. Go to ANZ bank and make a complain. Also make a complain with ACCC web site (someone will give you a call back from ACCC and ask for more details). Use the following info I managed to gather for digitechonline.com.au:

I lodged a complaint with Fair Trading. They have not been able to get in touch with Raed Malas, who is the registered owner of Clearly Australian Beverages, which in turn owns digitechonline. I have tried email Mr Malas directly through the Clearly Australian website, without any response. I did however get a response from him when I sent messages to all his friends and relatives on facebook, explaining why I was hoping to get in touch with him (he has $885 of my money, after I ordered and paid for 2 phones that have never been delivered, and I was told a refund would be sent). I would post his response, but due to the crude nature of it, I can't. And I still haven't got my money back, after nearly 8 weeks.

I believe the shares in Clearly Australian was transferred to his son/brother Mohammed Malas in June. Badwa is the accountant for Clearly Australian so he may provide an avenue of contact for us. I've lodged a complaint with Fair Trading, and also made a dispute with my bank. I'm thinking of lodgin a statement with the Campsie local police over the weekend, and if Fair Trading fails, lodge a complaint with the Consumer Tribunal. This would allow me to obtain a debt judgment (I suspect Mr Malas would not turn up in the tribunal, so it would be a default judgment) for the $33 application fee. I would then have to enter the judgment in the Local Court and seek to enforce it, either by writ of possession or seek to wind up the company. It would cost me about $230 to enforce the judgment but I am willing to pay that.

I will keep you guys updated on these proceedings.

I have had no luck going through Fair Trading in WA. They couldn't get a response from anyone associated with digitechonline or Clearly Australian Beverages. They advised that the best course of action is to go to magistrates court and get a ruling that Mohammed Malas is to refund my money. I have seen how this works, and even if you get the ruling that someone owes you money, it is up to you to find that person and try to get the money out of them. This seems like a waste of money (over $70 in WA). Esop2, if you have any luck keep us informed.

Well, my problem with this company was they send me a SECOND-HAND phone, from Asia, which was missing most of the original accessories. The phone had already had a sim-card in it, who are they kidding???

I have reported problems with Digitech/ Raed Malas to the NSW OFT and having had no response from Digitech to their communication, am preparing to submit my case to the tribunal. It appears however, a class action may be more appropriate. Whilst speaking informally to my lawyer regarding another matter, he suggested the possibility of criminal charges being laid upon this person and high chances of a conviction.

This guy is a repeat offender, having been fined by ASIC at least once in the past.
